Verkhovna Rada intends to ban the sale of alcohol at night across Ukraine

People's Deputy of Ukraine Volodymyr Danilenko (Communist Party of Ukraine) proposes to ban the sale of beer (except non-alcoholic), alcoholic, low-alcohol drinks, and table wines at night. This is evidenced by the draft law N8560, registered in the Verkhovna Rada on May 23, 2011.
According to the authors of the project, statistics show that alcohol consumption increases the number of injuries, accidents, crimes, illnesses and deaths several times.
According to them, the main consumers of beer, alcoholic and low-alcohol drinks, and table wines at night are young people. At the same time, the number of crimes committed while intoxicated is constantly growing, and a large number of crimes on this basis are committed at night.
Thus, the developers of the project propose to amend the Law "On state regulation of production and circulation of ethyl, cognac and fruit alcohol, alcoholic beverages and tobacco products". In particular, it is proposed to prohibit the retail sale of beer (except non-alcoholic), alcoholic, low-alcohol drinks, table wines from 11 p.m. to 6 a.m., except for trade on tap in restaurants, cafes, bars and other public catering establishments.
The draft also envisages amendments to the Code of Administrative Offences. Thus, according to the draft, violation by an employee of a trade or catering enterprise (organization) of the rules for selling beer (except non-alcoholic), alcoholic, low-alcohol drinks, table wine from 11 pm to 6 am, entails the imposition of a fine of 30 to 100 (510-1700 UAH) non-taxable minimum incomes of citizens.
Let us recall that the authorities of a number of Ukrainian cities have already introduced a ban on the retail sale of the aforementioned alcoholic beverages, beer and tobacco products.
According to the President of the Ukrainian Trade and Industrial Confederation (UTIC) Volodymyr Demchak, the introduction by the authorities of a number of Ukrainian cities of a ban on the retail sale of alcohol and cigarettes at night is illegal. Moreover, according to his data, in some cities this decision of local authorities was overturned by the court. According to V. Demchak, an entrepreneur, receiving a license for the sale of alcohol and tobacco, must only agree with the local authorities on the working hours of the enterprise. At the same time, the local authorities do not have the right to set working hours unilaterally, since this is a mutual agreement of both parties.
At the same time, it was not possible to ban the sale of beer in Kyiv kiosks. The District Administrative Court of Kyiv overturned the decision of the Kiev City Council to ban the sale of beer, low-alcohol drinks, wine and tobacco products in the capital's kiosks. Thus, the ban, which was supposed to come into force on April 1, 2011, was not in effect for a single day. The said ban applied to the sale of beer (except soft drinks), low-alcohol drinks, table wine and tobacco products in small architectural forms (SAF) (kiosks, stalls).
